{"id":2423,"date":"2018-06-07T08:30:25","date_gmt":"2018-06-07T08:30:25","guid":{"rendered":"https:\/\/www.empowerbpo.com\/blog\/?p=2423"},"modified":"2023-01-25T10:24:50","modified_gmt":"2023-01-25T10:24:50","slug":"colleges-fail-the-clery-act-audit","status":"publish","type":"post","link":"https:\/\/www.empowerelearning.com\/blog\/colleges-fail-the-clery-act-audit\/","title":{"rendered":"Clery Act Requirements- California Colleges Have Failed to Comply, State Auditors Report"},"content":{"rendered":"<blockquote><p><em><span style=\"font-weight: 400;\">The schools publicly reported inaccurate crime statistics and never told parents and students about programs for combating violence against women, as required, the audit found.<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">&#8211;<\/span><a href=\"https:\/\/www.sfchronicle.com\/bayarea\/article\/State-audit-finds-colleges-did-not-accurately-12905413.php\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">San Francisco Chronicle<\/span><\/a><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><\/blockquote>\n<p><a href=\"https:\/\/www.auditor.ca.gov\/pdfs\/reports\/2017-032.pdf\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">The audit report<\/span><\/a><span style=\"font-weight: 400;\"> published by the California State Auditors who audited a selection of California\u2019s institutions\u00a0<\/span><span style=\"font-weight: 400;\">shares the results of their examination of six colleges\u2019 <\/span><b>Annual Security Report (ASR) <\/b><span style=\"font-weight: 400;\">and disclosures of <\/span><b>campus security<\/b><span style=\"font-weight: 400;\"> policies required under the <\/span><b>Clery Act. <\/b><\/p>\n<p><span style=\"font-weight: 400;\">Of these six colleges, four reported criminal offences, while the two other two reported no criminal offences in their Annual Security Report. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The audit found that the four that reported criminal offenses did not do so accurately; and the one which reported no offences failed to report two serious crimes. In addition, five of them did not have complete or updated crime logs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And, only one college had fully disclosed all the information that the Clery Act and federal regulations require. Colleges are required to have specific security policy in place, and in most instances, disclose them in their Annual Security Report. However, five colleges failed to develop or disclosed all required policies. <\/span><\/p>\n<p><a href=\"https:\/\/www.sfchronicle.com\/bayarea\/article\/State-audit-finds-colleges-did-not-accurately-12905413.php\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">As per San Francisco Chronicles<\/span><\/a><span style=\"font-weight: 400;\">, the audit found disclosure errors in <em>20 percent<\/em> of examined crimes. <\/span><\/p>\n<h3><strong>Highlights from the State Audit Report<\/strong><\/h3>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Four colleges reported a significant number of inaccurate crime statistics. <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Of the two that reported no crimes, one failed to report two serious Clery Act crimes, and thus was unable to issue a timely warning to its students and employees. <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Five colleges failed to fully disclose information as required by the regulations. They attributed the lack of compliance to insufficient Clery Act expertise, insufficient training, or oversight.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A number of missing disclosures were related to policies related to the VAWA.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The daily crime logs of five colleges were incomplete and not updated. <\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><b>Why is Clery Act important? <\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Every college that receives federal student aid under Title IV has to commit itself to providing students with safe environment to learn, and keeping students, parents, and employees informed about campus security.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, commonly referred to as the <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Clery_Act\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Clery Act<\/span><\/a><span style=\"font-weight: 400;\">\u00a0requires such colleges to disclose specified campus crime statistics and campus security policies to help inform students, their families and the employees. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Colleges must report the statistics related to crimes such as criminal homicides, sex offences, robberies, and aggravated assaults; and they must disclose or have in place policies that address how they would respond to and prevent crimes. For crimes that represent continuous threat to campus, they must issue timely warnings and notifications to the students and employees.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Campus safety is a major concern of students and their families when they are choosing an institution. The Clery Act works towards that end, by requiring the colleges to prepare, publish and distribute annual security reports that disclose Clery Act crime statistics and their campus security policies.
