Title IX of the Educational Amendments of 1972 focuses on sexual misconduct and sex discrimination in educational programs and activities. 

Any incident, activity, or decision that can be deemed as sex discrimination or sexual harassment is a violation of Title IX. This includes – 

  • Sexual misconduct that’s severe, pervasive, and objectively offensive to deny equal rights to an educational program or activity
  • All sex discrimination
  • Program inequity
  • All forms of gender discrimination, including discrimination based on gender identity and sexual orientation
  • Discrimination against pregnant and parenting students

Title IX also applies to policy violations such as hazing, bullying, arson, vandalism, and theft, where the incident causes a discriminatory effect.

Title IX of the Educational Amendments of 1972 is a federal law prohibiting discrimination on the basis of sex in educational programs and activities. In essence, Title IX prohibits sexual misconduct (including sexual violence), sex discrimination (gender bias), and sexual harassment. 

In 2020, changes to Title IX amended the definition of sexual harassment under the law. Under the new rules, harassment must be severe, pervasive, and objectively offensive to deny equal rights to an educational activity or program. Title IX gives the victims of such harassment the right to receive supportive services and file an official complaint against the perpetrator.
